1. Application of this Privacy Policy

1.1 This is the Privacy Policy of DEBTMERC PTY LTD - ACN: 684 008 508 (Debtmerc, we, us, our).

1.2 We respect your privacy and are committed to protecting the privacy of your personal information as defined in the Privacy Act 1988 (Cth) (the Act).

1.3 We collect, hold, use, manage, and disclose all personal information in accordance with the Australian Privacy Principles (Principles) contained in the Act.

1.4 By using Debtmerc services or submitting personal information to us, you accept the terms of this Privacy Policy, and consent to our management, use, collection, disclosure, and retention of personal information, as described in this Privacy Policy.

1.5 If you disagree with any part of this Privacy Policy, please do not provide us with your personal information. However, doing so may limit or prevent your use of our website and Services.

2. The reasons why we collect Personal Information

2.1 Debtmerc is a debt collection agency that provides debt recovery, banking and finance collections, and legal action management services (Services).

2.2 We collect personal information reasonably necessary to operate our business.

2.3 We collect, hold, use, and disclose personal information primarily to provide Services to our clients.

3. What kind of Personal Information do we collect

3.1 We collect personal information from our clients, service providers, commercial agents, public records, government databases, credit reporting agencies, social media, directly from the individual and/or from your authorised representatives.  

3.2 The personal information we collect may include the following:

(a) Personal details - individual’s name, address, and date of birth;

(b) Identification details - driver's license, account numbers or other documents provided;

(c) Contact information - phone number, email address, business, residential, and postal address;

(d) Financial information - loan details, credit information, debts owed, repayment history, defaults, assets, liabilities, income, expenses, employment details and bank account details; and

(e) Information provided to us by the individual such as client files, written correspondence in any form, credit application forms, references and referees.

3.3 We do not collect sensitive information (as defined in the Act) unless it is:

(a) Provided to us by the individual who has consented to its collection and use;

(b) Provided to us by our client for the purpose of performing our Services; or

(c) Required or authorised by law.

4. Web Analytics and Cookies (Google Analytics)

4.1 We use Google Analytics to understand how you engage with our website.

4.2 When you visit our website, Google Analytics collects certain information that may constitute personal information or online identifiers under the Act. This includes:

(d) Our client or creditor who instructed us.

7.1 We will only disclose personal information overseas if it necessary for us to perform the Services.

10.2 Our Privacy Officer will review your complaint and endeavour to respond within 30 days.

10.3 If you believe we have not adequately resolved your complaint, you may complain to the Office of the Australian Information Commissioner (OAIC) via www.oaic.gov.au or by phone on 1300 363 992.

11.1 We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations.
